No company wants to see the fruits of its ingenuity and labor pirated on the global counterfeit market. Mount, Spelman & Fingerman has employed a broad array of effective tools to directly confront counterfeiters. Our efforts have resulted in the seizure of millions of dollars of counterfeit goods.

We proactively police our clients’ brands by working with U.S. Customs & Border Protection (CBP)—a bureau of the U.S. Department of Homeland Security—to stop knock-offs from entering the U.S. We have helped clients with their enforcement efforts against counterfeiters at the following ports:

  • We conduct training sessions with customs inspectors on how to tell the difference between genuine merchandise and knock-offs.
  • We initiate litigation in federal court to recover monetary damages and before the ITC to secure exclusion orders to prevent knock-offs from entering the U.S.
  • Since 80-90% of the world’s counterfeits originate in China, we identify and target the manufacturers responsible for making the counterfeits. Then we work with our China-based contacts and investigators to initiate police raids on those factories to close them down.
  • We collaborate with other rights-holders to share intelligence on violators and suspect shipments.
